Seat belt bills passed by Virginia Senate

Posted to: General Assembly News

The passionate advocacy of Chesapeake Republican Sen. Harry Blevins helped propel out of the Senate on Wednesday his bill to make non-use of seat belts a primary offense.

Under Blevins' legislation, SB 9, police could stop motorists solely for failure to wear the safety apparatus.

Current law defines seat belt violations as a secondary offense. A vehicle can't be stopped just for that reason, but a driver stopped for another infraction can also be cited for not wearing a seat belt.

Also gaining passage in the Senate was a seat belt bill from Sen. Tommy Norment, R-James City County, that would make non-use a primary offense only at police checkpoints.

Norment called that measure, SB 518, t he "dumb driver bill."
